Terms of service
These are the terms that apply when you shop with Oventa. We've tried to write them in plain language, because a policy nobody reads isn't actually protecting anyone.
Who you're dealing with
This site is operated by Oventa, located at 5730 Citrus Blvd, Elmwood, LA 70123. Throughout these terms, "we", "us", and "our" refer to Oventa, and "you" refers to whoever is placing an order or using the site.
Acceptance of these terms
By placing an order or otherwise using this site, you're agreeing to these terms. If you don't agree with something here, please contact us before ordering so we can try to sort it out, or don't proceed with the purchase.
Ordering
- You must be at least 18 years old to place an order.
- Placing an order is an offer to buy, not a completed sale. The contract between us is formed when we email you to confirm your order has shipped, not simply when checkout completes.
- We may decline or cancel an order for reasons that include, but aren't limited to: the item being out of stock, a pricing error, or an inability to verify that the payment method belongs to you. If we decline an order, you'll be refunded in full and promptly.
- Product photography is provided by the manufacturer or supplier. Colors can vary somewhat between screens and in person.
- We reserve the right to limit quantities on any order, particularly where we suspect resale rather than personal use, or where an order appears fraudulent.
Prices and payment
- All prices on this site are listed in US dollars. Applicable sales tax is calculated based on your delivery address and shown separately at checkout.
- We may change prices at any time going forward, but a price change will never apply to an order you've already placed.
- If an item is listed at an obviously incorrect price due to a typographical or system error, we'll contact you before shipping or canceling the order; you'll be able to choose whether to pay the correct price or receive a full refund.
- Payment is collected securely at checkout. We do not see, receive, or store your full card number at any point; that information goes directly to our payment processor.
Product information
Specifications, dimensions, capacities, and other details are sourced from the manufacturer wherever possible. We make a reasonable effort to correct obvious errors when we spot them, but we don't independently test every product we sell, and we don't claim to.
We don't sell branded products as our own. Where a product listing describes compatibility with another company's system (for example, an accessory that fits a particular brand of appliance), that's a statement of compatibility only. We are not affiliated with, sponsored by, endorsed by, or officially authorized by any manufacturer named on this site, unless we specifically say otherwise. We don't present other companies' products as if they were our own.
Every trademark, brand name, and logo referenced on this site belongs to its respective owner.
Shipping, returns, and cancellations
Full details on delivery timing and costs are in our shipping policy. Full details on returns, exchanges, and refunds are in our refund policy. Both of those pages are incorporated into, and form part of, these terms.
Acceptable use of this site
You agree that you will not:
- copy, reproduce, or repurpose the site's text, layout, or code for use in another store or business;
- scrape the site, or use it in a way that places an unreasonable load on it or interferes with other customers' ability to use it;
- submit false or misleading information when placing an order;
- use a payment method you are not authorized to use;
- use the site for any unlawful purpose, or in a way that violates any applicable law or regulation.
The text, layout, design, and overall photography arrangement on this site belong to us. Individual product photographs belong to the manufacturers and suppliers who provided them.
Limitation of liability
We're responsible for losses you experience that are a reasonably foreseeable result of us breaking these terms or failing to exercise reasonable care. To the fullest extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable, for indirect or consequential losses, for lost business or profits, or for damage caused by installing or using a product in a way its own instructions specifically warn against.
Nothing in these terms is intended to limit any right or remedy you have under applicable consumer protection law that cannot legally be limited or excluded. If any part of these terms conflicts with such a right, your legal right takes priority.
Events outside our control
Occasionally something genuinely outside our control can delay an order, such as a shipping carrier disruption, severe weather, or a supplier running short of stock. If that happens, we'll let you know what's going on and give you the choice of continuing to wait or receiving a full refund. We won't simply leave you without an update.
Changes to these terms
We may update these terms from time to time. The version that applies to any given order is the one that was published at the time you placed it, and the "last updated" date at the top of this page tells you which version is currently in effect.
Severability
If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Governing law
These terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws principles. You and we agree that any dispute arising out of or relating to these terms will be subject to the jurisdiction of the courts located in Louisiana.
